The 2026 halt at Praia do Toque

Anyone looking at São Miguel dos Milagres should start with a document, not a beach. On 31 March 2026 federal prosecutors issued Recommendation 3/2026 to the city, the state environment agency IMA and the local registry office. It asks them to stop issuing building permits and environmental licenses for new projects on the Praia do Toque sea front until a definitive project guarantees safe, unobstructed public access to the sea. The municipal master plan requires beach access at least every 500 meters, and prosecutors say that rule has been ignored, citing blocked accesses, narrow gaps between properties, walls and gates.

The city accepted in full by 9 April 2026. It halted new permits and the effects of licenses already granted in that coastal zone, especially the sector called the Setor de Orla de Uso Sustentável. The halt lasts until a definitive access project is drafted, approved and built. The city will also demand public beach access in subdivisions and condominiums, and will coordinate with IMA and the registry.

Two parts of this matter to a buyer. First, a license you were shown last year may no longer have effect, so ask for written confirmation from the city that the specific project can proceed. Second, prosecutors asked for the civil inquiry to be publicized in the title records of the region's properties and for measures against new subdivisions and registrations without public access to the sea. So read the unit's registry file (matrícula) for any such note, following the steps for checking title. Prosecutors say failure to comply can lead to a civil suit and possible demolition of irregular structures.

Roads, taxis and the ferry

Melhores Destinos puts the town about 95 km and 1 hour 40 minutes from Maceió's airport by the AL-105, the fastest road. That road is paved but runs through sugarcane and forest with long gaps between gas stations, and at night it is dark with weak markings. The alternative along AL-101 adds at least 40 minutes. There is no Uber or public transport in town, and few taxis without meters. The same guide quotes R$ 380 for an airport taxi and about R$ 660 for a hotel transfer in 2026.

From Recife it is about 220 km by BR-101, roughly 3 hours 35 minutes. From Maragogi it is about 35 km by way of the ferry across the Manguaba river, or about 70 km around by Porto Calvo when the ferry line is long. Guests need a car once they get here, because the area is spread out and the guide says the town has no rental agencies. That cost and inconvenience are part of what keeps it quiet, and a part of what a renter is paying for.

Prices, plots and rental numbers

No price index covers this town. Apto shows nine off-plan projects, every one in the Centro, with a mean of R$ 15,614/m² (R$ 9,997 to R$ 27,911) and a typical off-plan price near R$ 588,000. The streets it highlights are Rua Vereador Lamenha Couto, Rua Felisberto de Ataíde and Rua Praia do Toque, so check that last one against the halted zone. Its figures have internal inconsistencies, so get the current table and license in writing.

That average is close to what Apto reports for new units in Maceió itself at R$ 14,565, in a town with far fewer services. Buyers are paying for a low-density coast, which the 500-meter rule and the protected area help keep. That is our reading, and the reader should weigh it against the legal risk above.

BnBCalc's page for the town, in its 12-month reading to September 2026, gives R$ 775 a night, 32% of nights booked and annual revenue near R$ 107,000, in a parent market of about 2,000 Airbnb and Vrbo listings. It labels regulation lenient, with no dedicated short-let rules, and says to verify for each property. We publish no yield. A rate that high with occupancy that low suggests a good stretch at peak dates and long quiet weeks, so stress-test any plan against the rainy months and budget running costs from Maceió's cost figures. The national short-let rules also apply.

Living inside a protected coast

The town is one of the Alagoas municipalities named in the 2025 decree enlarging the APA Costa dos Corais, alongside Porto de Pedras, Maragogi and others. Beach works, including erosion barriers, need a permit from both ICMBio and the SPU, and earthworks and new roads that alter local ecology are restricted. The decree does not set building rules directly, but public and private investments must be compatible with it and with the management plan, which will also define preservation zones. A local architect can tell you what the plan says for your lot and whether protection works will be allowed if the sea advances.

Porto da Rua and Praia do Toque are the addresses you will hear, and the reef in front of them is why the boats are there. Federal land rules apply on the shore: the SPU told a June 2026 hearing in Maceió that sand and marine land belong to the Union and that mapping them is unfinished. Read the marine land guide before you pay for a first-row plot. Many sellers along this coast offer possession and not registered title, which is a general observation; the posse guide explains the difference.

Rain peaks mid-year here as in the capital, and Maceió's normal is 322.8 mm in June. Visit then if you can, since, as a general point, access streets show their limits in wet weather. For a beach town with easier access and a bigger local economy, compare Praia do Francês.

Questions about São Miguel dos Milagres

Can I get a building permit at Praia do Toque?

Not for now. The city halted new permits and the effect of existing licenses there in April 2026, until a beach-access project is built. Get written confirmation for any specific lot.

Do I need a car in São Miguel dos Milagres?

Yes. The travel guide we opened reports no Uber, no public transport and no car rental agency in town, so rent at the airport.

Is it inside a protected area?

Yes. It is named in the 2025 decree on the APA Costa dos Corais, which restricts earthworks, road opening and beach works without federal authorization.

What should I check in the title?

Look in the matrícula for any note about the federal civil inquiry on beach access, confirm access to a public road, and check the SPU position of the lot.
